Copyright & DMCA Policy

Charlestock respects the intellectual property of others and expects users to do the same. This page explains how to submit a Digital Millennium Copyright Act (DMCA) takedown notice or counter-notification.
If you believe your work appears on Charlestock without authorization
If you are the copyright owner of a work that you believe is being made available on Charlestock without your permission, you may submit a written notice of infringement under 17 U.S.C. § 512(c)(3) to our designated DMCA agent. Notices that do not include the elements below cannot be processed.
Required elements of a DMCA notice
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by a single notification).
- Identification of the material that is claimed to be infringing or the subject of infringing activity, with information reasonably sufficient to permit us to locate it — including the URL on charlestock.com.
- Information reasonably sufficient to permit us to contact you, including your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Misrepresentations in a DMCA notice may subject you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

What happens after we receive a notice
When we receive a notice that satisfies the requirements above, we will remove or disable access to the material expeditiously and notify the user who posted it (where applicable). We may also suspend the related account, particularly in cases involving repeat infringement.
Counter-notification
If you believe material was removed in error or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). A counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location at which it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Charlestock may be found), and that you will accept service of process from the person who provided the original notice.

Repeat infringers
In accordance with the DMCA and other applicable law, Charlestock maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
